North Texas and Lewisville Spousal Support Attorney
The potential for spousal maintenance obligations can be a big concern for clients experiencing a divorce. We serve as advocates for our clients to protect their best interests in the determination of any potential alimony or spousal support payments.
Factors in the Texas Family Code determine any potential spousal support obligations. Any disability, a lack of marketable job skills, the marriage length and the amount of property involved are major considerations. In general, spousal support is more difficult to arrange than it used to be.
-
For marriages of 10 to 19 years, maintenance has a five-year limit.
-
For marriages of 20 to 29 years, maintenance has a seven-year limit.
-
For marriages of 30 or more years, maintenance has a 10-year limit.
If a spouse lacks marketable job skills and is not able to earn enough income, an exception can be made. Spousal maintenance provides for minimum reasonable needs and has caps of 20 percent of the average income of the paying spouse or $5,000 per month.
